Terms of Service

These terms govern the services provided by Retainer ("we", "us") to your firm ("you"). By engaging us, you agree to these terms.

Our services

We provide done-for-you client-enquiry marketing for law and accounting firms, which may include strategy, ad creative, campaign management across advertising platforms, a dedicated landing page, lead tracking, and reporting, as described in your chosen plan.

Fees and ad spend

• Our fee is a fixed monthly retainer for the plan you select, billed in advance.
• Advertising spend is separate and is paid by you directly to the advertising platforms. We do not add a markup to ad spend.
• Any one-time setup fee will be agreed before work begins.

Term and cancellation

Our engagement runs month to month with no fixed lock-in. Either party may cancel with reasonable notice as set out in your plan. Fees already paid for the current period are non-refundable except where required by law.

Our performance commitment

Where a plan includes our enquiry commitment, if you do not receive qualified enquiries within the first 30 days of your campaign being live, you will not be charged the retainer for the following month. "Qualified enquiry" and the conditions of this commitment will be defined in your engagement, and it assumes you have provided the access, approvals, and reasonable ad spend needed to run the campaign.

What you own

The advertising accounts are established under your business, and the leads, data, and accounts belong to you. If our engagement ends, you keep them.

Your responsibilities

• Providing timely access, information, and approvals so we can deliver the service.
• Ensuring your services and any claims comply with the advertising and professional-conduct rules applicable to your profession. Final approval of all advertising rests with you.
• Paying fees and ad spend on time.

Limitation of liability

We provide our services with due care and skill, but we do not guarantee any specific volume of clients, revenue, or outcome beyond any commitment expressly stated in your plan. To the extent permitted by law, our liability is limited to the fees paid by you in the month in which the relevant issue arose. Nothing in these terms excludes rights you have under the Australian Consumer Law.

Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.

Changes

We may update these terms from time to time. The latest version will always be available on this page, and material changes affecting an active engagement will be communicated to you.
